TERMS OF USE

1. ACCEPTANCE OF TERMS
By accessing or using the APIs, web portal, and identity verification services (collectively, the "Services") provided by SS DYNAMICS SOLUTIONS PRIVATE LIMITED ("Company", "we", "us"), you ("Customer", "User", "you") agree to be bound by these Terms of Use ("Terms").
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity. If you do not agree to these Terms, you must strictly prohibit your employees and systems from accessing the Services.
2. SCOPE OF LICENSE
Subject to your compliance with these Terms and payment of applicable fees, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your internal business operations.
3. USER OBLIGATIONS & RESTRICTIONS
You acknowledge that the Services allow access to sensitive data and third-party infrastructure. You explicitly agree to the following strict usage limitations:
3.1. Permitted Purpose
You shall use the Services solely for legitimate business purposes, such as employee background checks, customer onboarding (KYC), loan disbursal verification, or vendor due diligence.
3.2. Prohibited Use
You represent and warrant that you will NOT use the Services, directly or indirectly, for:
- Any purpose that is anti-government, anti-state, or threatens the sovereignty and integrity of India.
- Money laundering, financing of terrorism, or any illegal activity.
- Purposes that are discriminatory or violate the fundamental rights of any individual.
- "Scraping," "crawling," or using any automated algorithm to extract data from the Platform outside of the intended API use cases.
4. DATA PROTECTION & MANDATORY CONSENT
You act as a "Data Fiduciary" regarding the information of the individuals ("Candidates") you verify.
- Mandatory Consent: You warrant that you have obtained explicit, informed, and verifiable consent from every Candidate before initiating a verification request through our Services. You shall maintain records of such consent and provide them to us upon request for audit purposes.
- Compliance with Laws: You agree to strictly comply with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and any other applicable privacy laws.
- Data Retention: You shall retain Candidate data only for as long as necessary to fulfill the specific purpose for which it was collected. Once the purpose is met, you must permanently delete or anonymize the data.
5. DISCLAIMER OF WARRANTIES
The Services rely on third-party databases, government records, and external APIs.
- "As Is" Basis: The Services are provided on an "as-is" and "best-effort" basis. We do not guarantee that the data provided is 100% accurate, current, or error-free.
- No Legal Advice: Reports generated by the Services are for informational purposes only and do not constitute a final legal pronouncement on a Candidate's background.
6. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless SS DYNAMICS SOLUTIONS PRIVATE LIMITED and its licensors/partners from any claims, damages, losses, or penalties arising out of:
- Your failure to obtain necessary consent from a Candidate.
- Your misuse of the data or violation of the Prohibited Use clause.
- Your breach of any applicable laws, including Data Protection regulations.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages (including loss of revenue, data, or business reputation) arising from the use or inability to use the Services.
8. TERMINATION
We reserve the right to suspend or terminate your access to the Services immediately, without notice, if:
- We detect suspicious activity or security breaches originating from your account.
- You breach any provision of these Terms, specifically the Consent or Prohibited Use clauses.
- Our upstream service providers verify a violation of their acceptable use policies.
9. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in New Delhi Indi.
